No, the only parties who know about the transaction are the Plaintiff, their attorney handling their case, and Oasis Legal Finance.
How much will Oasis Legal Finance advance to the Plaintiff?
It is important for all parties that the plaintiff not ask for too much on the case. This could make it difficult to settle if too much of the money is being used to pay off the advance. For this reason, Oasis Legal Finance typically limits the advance to 15% of the projected case value.
How would a lawsuit advance help the Plaintiff get more money from their case?
Often the defendant or their insurance company will attempt to settle the case early by offering the plaintiff far less than what the case may actually be worth. This is because settling the case often allows the defendant to save money; both in the litigation expenses and in the amount they pay out to the plaintiff. Also, litigation can sometimes take months or even years to resolve, but in the meantime, depending on the severity of the plaintiff’s injury, the plaintiff may need money sooner to help pay medical bills or day-to-day living expenses, so the plaintiff may feel pressured to take an earlier (and often less) settlement. With a plaintiff cash advance, this eases the immediate financial needs of the plaintiff and allows their lawyer to continue to fight their case for a fair award.
How is the Cash Advance repaid?
The cash advance is repaid from the proceeds of the case settlement, and is paid at the same time that the proceeds of the claim are paid out.
What if the plaintiff loses the case?
Oasis Legal Finance takes 100% of the risk with advancing cash to the plaintiff. If the plaintiff loses the case, then they do not owe Oasis Legal Finance anything.
